NH Bike Bill Passes State House of Representatives
House Bill 1203, the “NH Bike Bill”, is designed to update NH laws and policies concerning many aspects of bicycling. HB 1203 is sponsored by Rep. Gene Anderson of Grafton County. The Bike-Walk Alliance of NH has been active in raising awareness of the need for the bill’s provisions. SABR has also submitted testimony on the bill.
The model for this legislation is the highly acclaimed State of Maine law enacted in June 2007 dubbed "the three foot rule" - motorists must pass bicyclists with at least a three-foot clearance. However, a lot more is included in the bill. Allowing bicyclists to pass stopped traffic on the right when safe to do so, using the correct turning lanes, and even establishing a state-wide policies for rumble strips, drain grate placement, and road surface treatments are included.
Initial feedback from businesses, cyclists, and NH DOT has been very positive. This pending legislation is aimed at responsible and competent cyclists using their bicycles for transportation and recreation.
The bill was passed on February 12 by the House Transportation Committee at their scheduled Executive Session. The bill as amended was approved by an 11-3 vote and was sent to the full House for a vote on March 5. The amendment introduced by the House Committee added the suggestion that cyclists use reflective clothing or gear at night. This only makes sense and is a common point promoted in all bicycling education circles. The bill was added to the "Consent Calendar" for the March 5th vote by the full House and passed. The bill now crosses over to the Senate.
As of March 13, 2008, HB-1203 was introduced and referred to the Senate Transportation and Interstate Cooperation Committee; SJ 9, Pg.243. As of April 4, 2008 no hearing has been scheduled. For more information go to:
